Effect of Stimulus payments on SSI and Medicaid Recipients

The Commissioner of Social Security advised that SSA will not consider economic impact payments (stimulus payments) as income for SSI recipients, and the payments will be excluded from resources for 12 months.

For Medicaid recipients, the stimulus payments are treated the same as for SSI under the Cares Act, they are exempt as income and exempt as a resource for 12 months.

At issue is whether nursing home and adult home and ALP residents can keep the stimulus payments since they are not counted for Medicaid.

On April 13, 2020 NYLAG, MFJ, & NYAIL, joined by 14 other organizations, wrote to the NYS Department of Health requesting a directive to Nursing Home & Adult Home operators to ensure that the stimulus payments are protected for residents.
