Work Related Shoulder Injuries in NY

Workplace injuries can take many forms, but some of the more common injuries that we see involve shoulder injuries. Shoulder injuries can range from very minor (i.e. strains, sprains, dislocations, tendinitis) to much more significant (i.e. Rotator cuff tears, fractures, amputations). The minor injuries may only require conservative treatment such as physical or occupational therapy. The significant injuries could require surgery to repair.

If a shoulder injury happens while on the job, MCV Law's Workers' Compensation Lawyers have a record of results, helping secure benefits that may cover injury related medical bills and more.

Workers' Comp and Shoulder Injuries

Another type of injury that is considered a shoulder injury under NY workers' compensation law is a biceps tendon rupture. This type of injury usually requires surgical intervention fairly soon after the injury.

Shoulder injuries can result from accidents, or, they can result from repetitive activities such as overhead work or lifting.

Both minor shoulder injuries and serious shoulder injuries that require surgery to fix can result in permanent impairment of the arm. A permanent impairment of an extremity is known as a Scheduled Loss of Use and can entitle an injured worker to an advance award of compensation for the permanent injury.

Can I file a NY Workers' Compensation Claim if I fall in my employer's parking lot?

A common scenario we see during our Central New York winters are slip and falls in icy parking lots. The injuries that result from these incidents can range from a bruised ego to broken bones or worse. If a slip and fall occurs while you are entering or leaving work, then any injuries that result from the fall may be covered by NY workers' compensation.

Under NY workers' compensation law, an employee is entitled to safe ingress (entering work) and egress (leaving work). If you are injured on your way into work or leaving work and the injury happens on your employer's premises, then a workers' compensation claim can be filed. This holds true if the injured worker has not yet clocked in to work or if they have clocked out for the day. Again, the key factor is whether the employer owns the parking lot. If the injury occurs in a remote parking lot or in between the remote parking lot and the employer's premises, then whether the injury is compensable under NY workers' compensation law is not as straightforward. In some cases, an injured worker could be awarded a personal injury settlement in addition to Workers' Compensation benefits.
