SSA Request for Reconsideration Reinstated in New York

Social Security is reinstating Reconsideration in New York beginning January 1, 2019. This is an intermediate level of appeal, requested after the initial denial of benefits for Social Security Disability or Supplemental Security Income benefits.

This means the New York Residents who apply for Social Security Disability Insurance Benefits or Supplemental Security Income, or both, and who receive an initial denial determination on or after January 1, 2019, the first step of the appeals process will be to Request a Reconsideration of that determination. If SSA denies an individual at the reconsideration step, they may then seek further review of their claim by requesting a hearing before an administrative law judge.

It is important to be aware that as of January 1, 2019, individuals will have to timely file a Request for Reconsideration of a denied claim. If SSA denies the Reconsideration Request, which is more likely than not, then you file a Request for Hearing.
