In one of our most recent blogs, MCV Law Workers’ Compensation attorney Grace Salerno provided a detailed summary of the current situations in which Workers’ Compensation covers mental health care in New York State. Since then, a major development in this area of the Workers’ Compensation Law has taken place.
Governor Hochul recently signed a Bill sponsored by State Senator Jessica Ramos and Assemblymember Karines Reyes, which eliminates the requirement for the stress to be a result of a work-related emergency. The legislation also eliminates the requirement to show that the stress was greater than that which occurs in a normal work environment.
This legislation is designed to make it easier for Workers’ Compensation claimants to prove that they suffer from a work-related psychological condition. The exact language of the law will likely be decided in 2025, but the fact that it is being put in motion is a great step for workers in our state who are suffering from psychological injuries.
Legislation S.6635/A.5745 will allow any worker to file for Workers' Compensation for specific types of mental injury premised on extraordinary work-related stress. This expands coverage to all workers in the State of New York, not just first responders as originally established.
