NY Workers' Compensation for Doctor's Appointments

In New York State, Workers’ Compensation pays for medical treatment itself, but unfortunately does not pay for time taken from work to attend a doctor’s appointment. This includes physical therapy, an independent medical examination (IME), and your own doctor’s appointments. You are required to use your personal time or other benefits your employer may offer.

However, you are entitled to mileage reimbursement to and from these appointments. You must use the Workers' Compensation Board’s prescribed form, and complete and submit the form fully and accurately.

Workers’ Compensation only covers lost wages if you are unable to work due to your injury. You must have a doctor’s note taking you out of work and a corresponding medical narrative in order to receive lost wages. A request for lost wages is often ignored or denied by the Insurance Company, so a hearing may be necessary in order to get you paid. The hearing process is complicated and can be intimidating.
