2025 Workers’ Compensation Rate Changes: What Injured Workers Need to Know

New York State Legislative building

Good news for injured workers. Effective January 1, 2025, the minimum weekly Workers’ Compensation rate increased from $275.00 per week to $325.00 per week.

This means that for all workers who suffer a work injury on or after January 1, 2025, their Workers’ Compensation benefit cannot be less than $325.00 per week. This change is a significant benefit for injured workers, as the rate was $150.00 per week for over a decade.

Additionally, effective July 1, 2025, the maximum weekly Workers’ Compensation rate increases from $1,171.46 per week to $1,222.42 per week. Like the minimum rate, this means that the Workers’ Compensation benefit paid to an injured worker for lost time from work cannot exceed $1,222.42 per week. This rate applies to all injuries occurring between July 1, 2025 to June 30, 2026.

The maximum rate increases annually and is based on two-thirds of the State’s Average Weekly Wage.
