How Much Compensation Can I Be Awarded for a Work-Related Injury or Illness?
The total benefits awarded to injured workers in New York Workers’ Compensation cases are rarely the same from case to case. There are a number of factors that determine what an injured worker will be paid when they are out of work. Some of these factors may include:
- The Average Weekly Wage set in the case
- The degree of temporary disability listed in the medical records
- If the person has returned to work, are they receiving pre-injury wages
- Have the injuries been deemed to be “permanent”
In some circumstances, a work-related injury may give rise to other types of cases. For example, if you were injured on the job due to the negligence of a third party, such as a careless driver, the manufacturer of faulty equipment, or a general contractor who put your safety at risk, you may be able to collect a third-party Personal Injury settlement in addition to your Workers’ Compensation benefits. If your condition is debilitating enough to prevent you from working in the future, you may be eligible for Social Security Disability benefits as well.
MCV Law is unique in that we handle Workers’ Compensation, Personal Injury, and Social Security Disability cases for our clients. These cases have a complex interplay and must be carefully coordinated with one another to make sure that benefits received are maximized and mistakes are avoided. While not every work accident gives rise to all three types of cases, we will review the facts surrounding your injuries to make sure that all bases are covered and all potential sources of financial recovery are explored. Even if you think you only qualify for just Workers’ Compensation benefits, we will review your case to make sure.
MCV Law will assist you with your claim, and help guide you through every step of the legal process until you are awarded the benefits you are entitled to under the law.

Are There Different Kinds of Workers’ Compensation Claims?
In New York State, there are two kinds of Workers’ Compensation claims: accident claims, and occupational disease claims. Accident claims generally involve injuries that are sustained suddenly, such as broken bones, torn ligaments, burns, or concussions. Occupational disease claims involve chronic conditions that develop gradually over the course of performing a certain job, such as carpal tunnel syndrome, respiratory disorders resulting from multiple toxic exposures, or musculoskeletal problems caused by constant strain and repetitive motion. Here are some examples of accident claims and occupational disease claims associated with injuries and illnesses that are common to industries with a presence in the Oswego region:
Examples of injuries that may lead to an accident claim:
- A metalworker getting their hand caught in machinery
- An emergency room nurse slipping and falling while rushing between patients
- A truck driver getting injured in a motor vehicle accident
Examples of conditions that may lead to an occupational disease claim:
- A machinist developing a respiratory condition from inhaling metallic dust
- A painting contractor developing a respiratory condition from constant exposure to fumes
- An office worker developing carpal tunnel syndrome from the repetitive motion of typing
